Target of FBI siege tells his story Wednesday

Three years ago, federal agents shot and killed Randy Weaver's wife and son.
Wednesday, the white separatist gets to tell Congress, and the nation, his
side of the story.

Weaver and his daughter, Sara, 19, are scheduled to be the lead witnesses as
a Senate panel begins looking into what critics call one of the worst abuses
of power in FBI history.

Their testimony about the government's ill-fated raid on Weaver's Ruby
Ridge, Idaho, cabin - coming amid allegations of an FBI cover-up - will be
"really gripping," predicts Jess Walter, who interviewed the Weavers for his
new book on the case, Every Knee Shall Bend. "They both have such compelling
stories to tell."

Weaver is expected to talk about seeing an FBI sniper's bullet tear into his
wife's head as she stood behind a door holding their 10-month-old daughter.

And Weaver and his older daughter are expected to describe their fear during
the 11-day standoff with several hundred federal and local agents.

A key goal for Senate investigators is finding out how the reconnaissance
mission - U.S. marshals wanted to serve an arrest warrant on Weaver for
weapons charges - turned the remote hillside into a virtual war zone.

The Aug. 22, 1992, surveillance went terribly awry when a family dog that
spotted the marshals was shot.

A shootout that followed left Deputy U.S. Marshal William Degan and Weaver's
son, Samuel, dead. Vicki Weaver, Weaver's wife, was killed later by a
sniper.

There has been no evidence that Weaver, who surrendered 10 days later, ever
fired a shot at officers. The government last month agreed to pay $3.1
million to Weaver and his three daughters to settle a civil lawsuit.

Says Gerry Spence, Weaver's lawyer: The Ruby Ridge case stands as an
"unbelievably classic example of abuse of power vested in federal law
enforcement."

The hearings promise to address that issue, also raised by the National
Rifle Association, which says federal law enforcement agents have become
"jack-booted government thugs."

The Ruby Ridge hearings come on the heels of House hearings into the 1993
raid on the Branch Davidian religious compound near Waco, Texas, that left
four federal agents and more than 80 cult members dead.

The Waco hearings highlighted numerous examples of government bungling, but
little evidence of criminal wrongdoing. Things may be different in the Ruby
Ridge case.
Randall Day, the state prosecutor in Boundary County, Idaho, is considering
criminal charges against federal agents in connection with the Weaver case.

Meanwhile, the U.S. attorney's office in Washington is investigating a
possible cover-up by top FBI officials.

At issue is whether they tried to conceal their role in approving what
amounted to shoot-on-sight orders at Ruby Ridge - orders that veered sharply
>from  standard bureau policy of using deadly force only when someone's life
is at stake.

Five high-level bureau officials, two of whom admit destroying documents
during an internal review of Ruby Ridge, were suspended this summer by FBI
Director Louis Freeh.

Freeh, Attorney General Janet Reno and some of the suspended FBI officials
are expected to testify during the 10 days of hearings.

The hearings will try to steer clear of probing cover-up questions that
might derail any subsequent criminal prosecutions, says the panel's
chairman, Sen. Arlen Specter, R-Pa. But the question of where to draw the
line on police use of force will be closely examined.

"This is a recurrent problem every day in big cities, small towns: Deadly
force is used and this will be a classic in defining for law enforcement in
America what the Constitution allows," Specter says.

>From Los Angeles to Philadelphia, there are growing reports of local police
abuses. But the situation on the federal level may be more troubling, says
James Fyfe, a Temple University criminologist.

For one thing, most major police departments now have civilian review boards
that try to keep an eye on problems, says Fyfe, a former New York City
police lieutenant. Not so with federal agencies.

With rising institutional pressures on federal agents to make arrests,
"folks are a little less concerned about constitutional guarantees," Fyfe
says.

The following statement has been signed by a range of national socialist

STATEMENT:

               SOCIALIST ORGANIZATIONS CONDEMN ATTACK AT UCB BY
        "COALITION TO DEFEND AFFIRMATIVE ACTION BY ANY MEANS NECESSARY"
               AND THE REVOLUTIONARY WORKERS LEAGUE/NWROC

On Wednesday, August 30th at UC-Berkeley, the Coalition to Defend
Affirmative Action by Any Means Necessary, which is composed largely of
members of the Revolutionary Workers League, assaulted leaders of the
broad student Diversity in Action (DIA) coaliti on and sought to disrupt
DIA's pro-affirmative action rally.  Members of the Revolutionary Workers
League assaulted students and shoved them aside in order to seize DIA's
microphone and harangue the crowd gathered at the rally.  This followed a
pattern of disruption of DIA organizing by the Revolutionary Workers League.

As socialists, we condemn the actions of the Coalition to Defend
Affirmative Action By Any Means Necessary and the Revolutionary Workers
League (RWL).  The Revolutionary Workers League's actions in no way
reflect socialist values and contribute nothing to social change,
"revolutionary" or otherwise.  The Revolutionary Workers League, both
under that name and its National Women's Rights Organizing Committee
(NWROC) name, has a history across the United States of similar disruption
and undermining of progre ssive coalitions.

We call on all socialists and left-minded individuals of principle to
reject the tactics of the Revolutionary Workers League and the Coalition
to Defend Affirmative Action by Any Means Necessary.

Militant socialist values can and must be promoted with respect for the
broad progressive movements.  There is no room in the left for the
sabotague and disruption that has been too common a characteristic of the
Revolutionary Workers League.

As members of the left, we are committed to supporting progressive change
and our allies fighting for affirmative action.

ATF Chief Admits 'Inexcusable' Action in Weaver Case

WASHINGTON (AP) - While defending his beleaguered agency before skeptical
senators, the head of the Bureau of Alcohol, Tobacco and Firearms
acknowledged an "inexcusable" action in the siege of white separatist Randy
Weaver.

ATF Director John Magaw made the admission at a Senate hearing Friday on the
1992 standoff at Ruby Ridge, Idaho, that ended with the deaths of Weaver's
wife, his 14-year-old son and a deputy U.S. marshal.

Under questioning by Sen. Arlen Specter, R-Pa., Magaw said it was
"inexcusable" that an ATF agent characterized Weaver to the U.S. attorney's
office as a suspect in bank robberies. Weaver wasn't a suspect, he said.

"How that got turned around in that manner, I'm not sure," Magaw added.

Weaver's sale of two sawed-off shotguns to an ATF undercover informant and
his failure to appear for trial led to the 11-day standoff and fatal
shootout at Weaver's mountain homestead.

When the hearings resume next Tuesday, the FBI sniper who shot and killed
Weaver's wife, Vicki, as she stood in the doorway of the family's cabin, is
expected to testify. A Justice Department report criticized the sniper, Lon
Horiuchi, for firing the shot.

Weaver was acquitted of the illegal-firearms charge in a 1993 trial.

Magaw's testimony before the Senate Judiciary subcommittee on terrorism came
at a time when the ATF has been under intense political fire.

Several weeks ago, the Treasury Department agency and the FBI were barraged
with criticism by Republicans at House hearings for their handling of the
deadly 1993 standoff with the Branch Davidian sect near Waco, Texas.

Also this summer, a videotape surfaced purporting to show virulently racist
activities at an annual "Good Ol' Boys" picnic for federal agents organized
by a former ATF agent. The Justice and Treasury departments have begun
investigations and the full Senate Judiciary Committee held well-publicized
hearings.

At Friday's hearing on Ruby Ridge, Specter, who is seeking the GOP
presidential nomination, noted that ATF guidelines are geared to rewarding
informants based on the magnitude of the violation and punishment. Such a
policy "puts a premium on a motivation to falsify," he suggested.

Magaw replied, "Your point is well taken" and he promised to review the
matter: "You can consider it done."

Specter said the law enforcement focus on Weaver was "above and beyond the
facts of the case." And Sen. Charles Grassley, R-Iowa, said it creates the
perception of selective prosecution.

"I don't see it" that way, Magaw responded.

Specter said ATF case agent Herb Byerly sent an inaccurate letter about
Weaver to the U.S. attorney's office saying Weaver had a criminal record.
Separately, a memo in the marshal's office stated that an ATF agent told the
U.S. attorney's office that Weaver was a suspect in several bank robberies.
He wasn't.

Earlier in Friday's hearing, the ATF undercover informant who bought the
guns from Weaver, Kenneth Fadeley, insisted he did not trick Weaver into
making the illegal sale. He said the white separatist offered to "supply me
with shotguns all day long."

Testifying from behind a partition, his voice distorted electronically to
disguise it, Fadeley said Weaver abruptly declared one day in October 1989,
"I would like to go to work for you." At the time, Fadeley, posing as a gun
trader, was infiltrating right-wing extremist groups such as the Aryan
Nations for the ATF.

_Student Mistaken For Skinhead Beaten_ (ANA)

A 13-year-old Little Rock, Arkansas, student was beaten last Friday
(9/8/95) by students who thought he was a skinhead.  Joshua Martinez shaved
his head in solidarity with his mother who lost her hair from chemotherapy
treatments due to breast cancer.  The fight is said to have started when a
student told another group of students that Martinez was a skinhead.  The
group later approached Martinez outside the gym when he was alone.
Martinez said that the group "walked up behind me.  They were cussing.
They were accusing me of being in the KKK and the skinheads."  Martinez
said one student hit him in the back of the head.  After the beating,
Martinez had a black eye, cuts and scrapes.  One student was suspended for
the incident, and Martinez' parents want him charged with battery.

BLACKS IN AMERICA--1992
(Statistical Brief SB/94-12, Issued May 1994)

The Black population in the United States numbered 31.4 million in
March 1992, comprising 13 percent of the Nation's total. This Brief
uses data collected by the March 1992 Current Population Survey (CPS)
to explore the state of Blacks in America. It examines how their
situation changed between March 1980 and 1992, as well as how their
condition compares with that of the White population.

POPULATION GROWTH
Between 1980 and 1992, the Black population increased an average of
1.4 percent per year, twice the annual growth rate of the White
population (0.6 percent).  The vast majority of this growth (84
percent) came from natural increase; the remainder came from
immigration.

GEOGRAPHIC DISTRIBUTION
Blacks are concentrated in the South. In 1992, more than one-half of
Blacks, but less than one-third of Whites, lived there. In addition,
Blacks were twice as likely as Whites to live in central cities (56
percent compared with 26 percent) and less likely to live in the
suburbs (29 percent versus 51 percent).

EDUCATION
Blacks are closing the high school diploma gap. Back in 1980, 51
percent of Blacks aged 25 and over had earned at least a high school
diploma; the corresponding figure for Whites was 71 percent. Twelve
years later, this gap had closed from 20 percentage points to 13 points
(68 percent versus 81 percent).

However, the proportion of adults aged 25 and over with at least a
bachelor's degree grew by equal percentages over the period for both
groups--from 8 percent to 12 percent for Blacks, from 18 percent to 22
percent for Whites.

A college education, incidentally, does pay off. The median earnings in
1991 of year-round, full-time Black workers aged 25 and over who were
high school graduates only was $18,620. But those with at least a
bachelor's earned $30,910.

FAMILIES
Proportionately fewer families today (both Black and White) contain a
married couple. Such families comprised 56 percent of all Black
families in 1980, but just 47 percent in 1992. The corresponding
decline for Whites was smaller, from 86 percent to 82 percent.

Families maintained by women with no spouse present rose from 40
percent to 46 percent of Black families; the proportion maintained by
men with no spouse rose from 4 percent to 7 percent.

As a result, just 36 percent of Black children and 77 percent of White
children under 18 years old lived with both parents in 1992. The
corresponding 1980 figures were 42 percent and 83 percent.

JOBS
In March 1992, Black men (aged 16 and over) were less likely than White
men to be in the labor force (70 percent compared with 76 percent).
However, the labor force participation rates for Black and White women
(58 percent) did not differ. The unemployment rate for Blacks (14
percent) was more than double that for Whites (6 percent).

Proportionately fewer Black than White men worked in managerial and
professional specialty jobs (14 percent versus 27 percent); relatively
more Black men were operators, fabricators, and laborers (31 percent
versus 19 percent) and held service jobs (19 percent compared with 9
percent). It was more common for Black than for White women to work in
service jobs (28 percent versus 17 percent), less likely for them to
work in managerial and professional specialty (20 percent versus 29
percent) and in technical, sales, and administrative support jobs (38
percent versus 45 percent).

INCOME
The median income for Black families was $21,550 in 1991, 57 percent of
the total for White families. After adjusting for inflation, family
income for both groups was unchanged from 1979. But income has changed
for different family types:

 - Black married-couple families saw their real median income rise 8
   percent over the period, to $33,310 in 1991. Their income was 80
   percent that of comparable White families in 1991, unchanged from
   1979.

 - Real median income for Black female householder families dropped
   10 percent from 1979 to 1991. It stood at $11,410 in 1991, 58
   percent that of comparable White families. The ratio was unchanged
   from 1979.

EARNINGS
In 1991, the median earnings of year-round, full-time Black male
workers was 73 percent that of comparable White males ($22,080 versus
$30,270). Black female year-round, full-time workers earned 90 percent
that of their White counterparts ($18,720 compared with $20,790). The
Black-to-White earnings ratios didn't change between 1979 and 1991 for
either sex. (See table above.)

POVERTY
Between 1979 and 1991, poverty rates changed little for Black and White
persons and families in general, but rates did change for certain
groups. For instance, Black related children under 18 years old in
families saw their poverty rate rise from 41 percent to 46 percent over
the period. The table below 1991 poverty rates for different groups.

HOME OWNERSHIP
Black householders were much more likely in 1992 to rent than to own a
home (56 percent versus 42 percent); the opposite was true for Whites -
31 percent were renters, 67 percent were owners.

 WHITE HOUSE MONITORING OF DISSIDENTS ON THE INTERNET

    The  National  Security   Agency   presumably   can   monitor
subversive  communication  on  the  Internet  without leaving any
trace  by  "sniffing  packets"  at  traffic  nodes.  For   purely
political  purposes, however, the White House may be forced to do
the monitoring in-house,  which  means  that  they  leave  traces
everywhere they go.

    With  just  a  superficial  search  for  such   traces,   The
Washington   Weekly   has   uncovered   intensive  monitoring  of
"dissident" Internet sites by the White House.

    It turns out that computers from inside the White House  have
kept  pretty  good  tabs  on information available on Whitewater,
Vince Foster, and Mena at a few key repositories  on  the  World-
Wide Web, a subset of the Internet.

    Just  three  such  sites:  "The   Washington   Weekly,   "The
Whitewater  Scandal  Home  Page" and "Whitewater & Vince Foster,"
were accessed 128 times by  four  computers  from  the  Executive
Office  of the President between August 28 and August 31.  If the
White House is showing a similar interest in other sites  on  the
World  Wide  Web,  that would amount to a monitoring operation of
considerable magnitude. Tim Brady of the  Yahoo!  World-Wide  Web
index  says  that his company alone has indexed approximately 725
political  sites.  That  monitoring  effort  would  be   nothing,
however,  compared  to  the  effort  required to follow all anti-
Clinton discussion on the Usenet, another subset of the Internet.

    The White House did  not  respond  to  an  inquiry  (attached
below)   asking  for  an  explanation  and  asking  whether  this
constituted "casual browsing."

    Interestingly, the week after the  White  House  snooping  of
files,  which included a series of articles by J. Orlin Grabbe on
Vince Foster's ties  to  the  NSA,  the  following  little  piece
appeared in Newsweek Magazine:

  "Conspiracy theorists perked up when Deborah Gorham told Senate
  Whitewater investigators in June that her boss, the late deputy
  White House counsel Vince Foster, asked her  to  put two secret
  notebooks  from  the  National Security Agency in a White House
  safe. The suggestion that  Foster  dealt  with  the NSA sparked
  feverish  speculation  on the  Internet that he was involved in
  espionage. The reality appears more prosaic.  The  White  House
  won't give details,  but  sources say Foster's files dealt with
  legal questions about national emergencies...."


    Does the White House follow anti-Clinton discussion on Usenet
newsgroups just as closely? [See alt.current-events.clinton.whitewater]
The  White House  posts press releases to Usenet in collaboration 
with the Artificial Intelligence Lab at  Massachusetts  Institute
of  Technology.  But  MIT  System Administrator Bruce Walton says
that the White House does not use the  same  server  for  reading 
netnews.   It  would  be difficult - although not impossible - to 
find the server that the White House uses for reading or receiving 
netnews and check for traces on that server.

    Readers may be tempted to post a threat to the President on a
newsgroup just to see if they get a visit from the Secret Service
the next day. That experiment is not advisable. It is a  criminal

the White House has published for the president.

Dear Ms. Terzano:

    It has come to my attention that several dissident  sites  on
the  World  Wide  Web  have been visited by White House computers
this week.  Apparently,  all  information  regarding  Whitewater,
Foster, and Mena has been transferred to White House computers.

    Specifically, the sites,  

"Washington Weekly" (http://www.federal.com),  
"The Whitewater Scandal Home Page"
(http://www.cs.dartmouth.edu/~crow/whitewater/)
"Whitewater & Vince Foster" 
(http://www.cris.com/~dwheeler/n/whitewater/whitewater-index.html)

have  been  visited  by  White  House   computers   ist1.eop.gov,
ist6.eop.gov, ist7.eop.gov, and gatekeeper.eop.gov between August
28 and August 31, and a total of 128 files have been  transferred
to those White House computers. For all sites, this constitutes a
significant  increase  over  previous  access  by   White   House
computers.

    In light of this information, I have the following questions:

(1) Does this constitute "casual browsing" by White House staff, or
    is it, in light of the considerable time and effort spent during 
    regular business hours, part of a monitoring or intelligence operation?

(2) For what purpose is the information transferred to the White House used?

(3) Does the White House keep information from these web sites on file,
    and does the White House keep a file on the persons responsible for
    these web sites?

(4) Is the April 9 statement by David Lytel of the White House Office of
    Science and Technology to Amy Bauer of Copley News Service that the
    administration does not monitor anti-Clinton activity on the web still
    operative?

I fully support creating this newsgroup. It will speed or rather help
speed up the seccessionist movement in this country. Also, it will help
polarize the races even more. Blacks deserve equal time on the net.
You have my support nat turner. Together, white and black nationalists
can plan strategies over the net. Victory can be for all.
