Submitted by:
Dr. R. Servatius
14 August 1961

Note: These written submissions were supplementary to the

They follow the order of the Counts of the Indictment.
Under each Count, they commence with a Precis of the
Arguments for the Prosecution (under para. I), arranged by

Proof" (i.e. Documents, generally bearing the No. of the
Court Exhibit and of the Prosecution Catalogue, and
testimonies) relied on by the Prosecution, with a brief
description of each item of proof (here this description has
been omitted, since each item can be perused in full in its
proper place in the volumes of this publication. Under

II.Argument for the Defence

As to 1. (I a)

Initiative and planning did not emanate from the Accused.

All central authorities of the Reich were active in that
regard.

      1. T/114 - Document 76
      2. T/125 - Document 460

     27. T/296 - Document 765
     28. T/196 - Document 93

2. (I b) Competence of the Accused. Rounding-up,
Deportation, Extermination.

     Means of Proof:
     29. T/116 - Document 1368
     30. T/96 - Document 919
     31. T/645 - Document 1562

     35. T/94 - Document 1241
     36. T/97 - Document 920

3. (I c) Orders for Extermination to Local Police
Headquarters and Central Offices in Vienna, Prague, and
Berlin.

While Eichmann himself was in charge of Central Offices
(Zentralstellen), those served only for emigration. After
he became Section Head at the Head Office for Reich
Security, he gave directions to them, under orders
concerning deportation, as received by him.

     Means of Proof:

     37. T/113 - Document 782
     38. T/742 - Document 1280
     39. T/730 - Document 1278
     40. T/139 - Document 1663

4. (I d) Acting through BdS (Senior Commander of the
Security Police) and Specialists for Jewish Affairs

The Department Heads at the Head Office for Reich Security
were entitled to give directions to the BdS on matters
within their competence. However, the BdS, on his part, was
subordinate to the Higher SS and Police Leader, who was
himself not subordinate to the Head Office for Reich
Security, but directly to Himmler. The Accused issued
provisional directions to the Specialist for Jewish Affairs
at the BdS, but these were converted into specific
operations by the office of the BdS.

     Means of Proof:

     41. T/98 - Document 554
For further means of proof, see under I k.
